The Occupational Safety and Health Administration, the Obama Administration, Local Farmers, and Executive Branch Tyranny

The Occupational Safety and Health Administration’s (OSHA) decision to enforce regulations on certain small farms amounts to ‘blatant overreach’ that unfairly targets small farmers, a pair of Senate Republicans argues.

Senators Mike Johanns (R-Nebraska) and Jerry Moran (R-Kansas) are calling on the Labor Secretary Tom Perez to rescind OSHA guidance clarifying that the agency intends to enforce regulations on farms with less than 10 workers (OSHA has NO constitutional authority over any farm unless the farm is located in two or more States!—my addition).

For decades, Congress has inserted language in appropriations bills prohibiting OSHA—an arm of the Labor Department (The Labor Department is an unconstitutional Department of the federal government!—my addition)—from enforcing provisions of the 1976 Occupational Safety and Health Act at farming operations with 10 or fewer employees.

But in recent months, the agency has begun issuing thousands of dollars in fines under the statute, saying that it has jurisdiction over non-farming operations—including grain storage—on farms, the lawmakers said (Executive overreach for the purposes of control!—my addition).

‘Lo and behold, OSHA has decided it can label certain sections of the farm as something else—by fiat—and send in their inspectors (What is new! We have an out of control executive branch who believes they are the law of the land! It is called tyranny!—my addition),’ Johanns said in remarks on the Senate floor before Congress adjourned for the year. ‘OSHA ignored what Congress directed.’

OSHA’s
guidance, issued back in 2011, was meant to clarify the agency’s authority at small farms with grain storage structures, the agency said at the time.

‘Many of these small farm employers mistakenly assume that the Appropriations Rider precludes OSHA from conducting enforcement activities regardless of the type of operations performed on the farm,’ a section of the guidance reads.

But Johanns and Moran say the regulation of small farms under the worker safety law defied congressional intent (Does OSHA care? NO! Will anything change! Not unless the Republicans get a spine and stop being the Capitulation Party!—my addition). The lawmakers urged Perez to issue corrected guidance by next month.

They said overzealous regulation has left farmers with the impression that the federal government is unfairly targeting them.

‘OSHA’s distorted definition of farming in order to expand its jurisdiction serves as evidence that farmers concerns are legitimate concerns,’ Johanns said.”


Its just another example of the increasing executive tyranny being practiced by the Obama Administration. They believe they are a law unto themselves.



This is my two part suggestion to Tea Party groups, social conservatives, Constitutionalists, and anyone else who wants to save our Republic from the approaching destruction.

1) Run as many conservative candidates in as many Republican primaries as possible.

2) Then, run as many independent and/or third party candidates as possible in as many races as possible where we did not win the primary.

That is why I am working to get the Constitution Party on the ballot in Texas. If we get on the ballot, we will have two Congressional House candidates running and two State candidates running. Getting on the ballot is the first step. Winning elections is the second. Winning elections will grow the Party. The Constitution Party is much more in line with the Tea Party movement than is the Republican Party. And I have been involved with all three!

If elected to Congress, I will not, under any circumstances, vote for present Speaker of the House John Boehner to be Speaker of the House. I call on every Republican primary candidate running in Texas Congressional District 19 to publicly (in writing) make the same pledge. It would not be a bad idea for every Republican candidate running for the House of Representatives to give the same pledge. If I am elected to the House, I will use the Constitution, as written, to do everything in my power to stop judicial tyranny! Will the other candidates pledge the same? I know our present Representative has NOT done everything possible to stop judicial tyranny! Why is that?




Competition is good for the economy and competition is good for the Republican Party!!! Competition keeps Congressmen committed to we the people!!! Primary Republicans who do not support the Constitution as written.
