The United States Constitution: Is It or Is It Not Constitutional

Update: Heard on the 7PM ABC radio news that according to a just released poll about 50% of those polled disapprove of how President Obama is handling the shut down. About 60% disapprove of Democrats handling and about 70% of the Republicans handling. Of course, they never give the questions asked so it is impossible to knew if the questions were slanted. Plus, I don’t trust anything that comes from the mainstream media when it come to polls or anything else for that matter.
That said, I’ve been hearing about the poll all day. The 7PM report was the first time they also said that “even conservative Republicans disapproved of the Republicans handling of it by a 59% margin.” And I immediately said, of course! And that is why the Republican figure is higher than the other two. As a conservative Republican, I do not like President Obama’s handling of it and of the Democrats handling of it. I also do not like the Republicans handling of it but for a very different reason. I don’t think they should have compromised down from defunding to delaying. Now, I’ll take delaying over funding. But, we should have stayed with defunding throughout. And that friends is why the Republican number is so high. Democrats don’t like the Republican position because they want funding. And conservative Republicans don’t like the Republican position because we want DEFUNDING! That said, I urge ALL Republicans to stand firm on delaying! Those who do not will be primaried!!! Competition is good for the economy and competition is good for the Republican Party!!! Competition keeps Congressmen committed to we the people!!!

Case will force school to defend ‘free speech zone’ in court
One of several college students banned from handing out copies of the U.S. Constitution on Constitution Day last month has filed a lawsuit.
A student rights organization backing Robert Van Tuinen says Modesto Junior College in California now will have to defend its idea of ‘free speech zones’ in court.
WND reported in late September on a series of confrontations between school officials and students wishing to hand out copies of the Constitution.
Now represented by the law firm Davis Wright Tremaine and backed by the Foundation for Individual Rights in Education, or FIRE, Van Tuinen has filed a lawsuit.
FIRE President Greg Lukianoff said the school administrators, who were caught on camera intervening, ‘were so unfamiliar with the basic principles of free speech that they prevented him from passing out the Constitution to his fellow students on Constitution Day.’
‘Even in the face of national shock and outrage, the college has failed to reform its absurd ‘free speech zone.’ Now it will have to defend that policy in federal court,’ he said.
Van Tuinen was in a grassy area by the student center Sept. 17, the anniversary of the Constitution’s signing, when authorities halted his effort.
A campus police officer informed him that he could not pass out any materials without first registering with the student development office, according to FIRE. Van Tuinen unsuccessfully attempted to convince the officer that his right to free speech was being violated, and he went into the student center at the officer’s request.
According to FIRE, Van Tuinen spoke with MJC administrator Christine Serrano, who told him that he could only pass out literature inside a ‘free speech zone.’ The zone, he was told, was ‘in front of the student center, in that little cement area.’
Eventually, college President Jill Stearns said ‘students may distribute printed material on campus in areas generally available to students and the community as long as they do not disrupt the orderly operation of the college.’
The case raises multiple counts of violation of free speech rights under the First Amendment, both as the rules were applied to him and as written, FIRE said. It also charges the district with violating the right to free speech guaranteed in the California Constitution and with failing adequately to train its employees to respect students’ rights.
‘Constitutional law can get pretty complicated at times. This is not one of those times,’ said FIRE Senior Vice President Robert Shibley. ‘As FIRE has said from the beginning, every person at Modesto Junior College responsible for enforcing this policy should have known better.’
According to a report from Young Americans for Liberty, a group with more than 380 chapters and 125,000 students promoting liberty, at least two other colleges did the same thing.
At the College of Central Florida in Ocala, and officer told students they would have to go through his office to get permission ‘any time you want to approach our students.’
‘We can’t hand out Constitutions?’ an incredulous student asked.
‘That’s right.’
Citing the need for ‘proper protocol,’ the officer said students could submit a request, and school officials would ‘check our calendar, make sure it doesn’t conflict with what we’re doing, then we’ll approve it or deny it.’
Likewise, at Madison Area Technical College in Wisconsin officials made certain students understood.
‘Would you like me to go and get security to explain it in more detail?’ one official demanded of the students.
The students were ushered off of what the school considered its sidewalk to another ‘public’ sidewalk.
‘You need to request the time and place that you want to have that activity,’ the school official said. ‘You can’t just show up.’
Alyssa Farah, director of communications for YAL, asserted the colleges ‘are in clear violation of the First Amendment.’
‘Simply put, the mere concept of a ‘free speech zone’ is an affront to liberty and should have no place on college campuses,’ she said.”
Is the activity of handing out the Constitution constitutional or unconstitutional? It depends? Here is the problem. The Constitution has been unconstitutionally rewritten by unconstitutional federal court decisions. Thus, one has to consider if one is using the Constitution as written or the Constitution as rewritten by the federal courts.
The first Amendment clearly states the following:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
Since none of the educational institutions are federal and since there is no federal law involved, clearly the Constitution as written does not apply in these circumstances. So, why is, at least, one case going to federal court?
“‘Now it will have to defend that policy in federal court,’ he said.” Because the Supreme Court has unconstitutionally rewritten the Constitution saying that the First Amendment should be applied to the States as well as to Congress. And that is where all the difficulties come into play.
People who really believe in the federal system would not take this to a federal court because it is not a federal question. However, by court decisions, the Supreme Court has made it a federal question. As a result of the Court’s expansion of the First Amendment, almost anything can now be considered to be a “free speech” question going far, far beyond what was originally intended by the Founding Fathers. In fact, I would venture to say that if the Founders returned and observed the operations of the federal government, they would ask when we scrapped the Constitution and replaced it with another!
Can we ever get back to the original document as written? Certainly, not overnight. The real question though is this: Is there a will to do so? Far too many have no knowledge of what the Constitution actually says and requires. To a great extent, our current President considers it just pieces of paper to be used when convenient and ignored at all other times. If it is going to be changed back to what it was, it will be up to we the people. Do we have the will to do it? That is the question!

The Obama Administration is spending money to block access to the World War II Memorial, using veterans as pawns as he works to save the abortion-pill mandate.
The World War II Memorial is open-air and open 24 hours a day, but the Obama Administration brought in forklifts, barricades, and security to shut it down.
President Obama would rather block World War II vets from their memorial than delay his individual mandate for even one year or give up on his abortion-pill mandate.
