The following demand letter was sent today to the representative of my mother's new Trustee

DEMAND LETTER to ATG Trust Company

RE: Demand letter for payment for past services rendered—January 9, 2013.

Since the court (Case #: 12-LM-156) has seen fit under Illinois law to retroactively declare null and void the verbal agreement between my mother—a Trustee of the trust at the time—and me, my portion of the agreement is also obviously null and void. Therefore, I must insist that the trust compensate me for the extensive services I rendered to my mother over the seven plus years that were covered by the now null and void agreement.

Those services included but were not limited to being 1) a financial advisor 2) an accountant 3) a tax consultant 4) a de facto trustee 5) a maintenance man for the house and yard 6) a chauffer 7) a grocery shopper 8) a care giver for my mother 9) a cook 10) a housekeeper 11) a daily companion 12) the care giver for mom’s cat and 13) a guard and protector of mother and the house included under the trust. I did these services twenty-four hours a day, seven days a week, for over seven and one half years with no breaks except for two weeks when I went back to Tucson. Other than the two weeks away, I was home every night without exception.

Furthermore, I almost certainly saved mother’s life when the stove was leaking natural gas because the burner knob did not shut down the gas flow completely. Also, I was present from the beginning and involved each and every time an ambulance had to be called and/or mother was taken to the emergency room of the hospital.

Using the very minimum figure of $7.00 per hour for services rendered and 16 hours per day for services provided including guard and protector of the home, the following compensation for services rendered seems to be the minimum compensation that should be provided:

1st year: from June 5-December 31, 2004 = 209 days X $7 X 16 hours = $23,408
      2nd year: all year minus 14 days 2005 = 351 days X $7 X 16 hours = $39,312
                               3rd year: all year 2006 = 365 days X $7 X 16 hours = $40,880
                               4th year: all year 2007 = 365 days X $7 X 16 hours = $40,880
                               5th year: all year 2008 = 366 days X $7 X 16 hours = $40,992
                               6th year: all year 2009 = 365 days X $7 X 16 hours = $40,880
                               7th year: all year 2010 = 365 days X $7 X 16 hours = $40,880
                               8th year: all year* 2011 = 31 days X $7 X 16 hours = $03,472                                      
                                      Total compensation for services rendered due = $270,704
*consisting of a minimum of 31 days in January. I will forgo any further compensation.

Please pay the above listed total as compensation for services provided to Martha E. Vance within fourteen days of receipt of this letter. Thank you very much.

There has been a major change in direction. The LORD is good! I thought I had sent the following e-mail yesterday afternoon, turns out it went into my draft documents. I'm using a computer that I am not used to and it shows. I sent it this morning.

First, how is mom doing? I missed her birthday and haven't had any messages about her condition in some time. Please update me.

Second, our church recently hired a new minister. Earlier today, he and I had a long biblical conversation about our situation. He convinced me biblically that I could not force you or anyone else into repentance by a hunger strike or any other means. Repentance must be voluntary and personal. Just as no one can be forced into becoming a Christian, no one can be forced to repent. Therefore, the hunger strike will not occur. Furthermore, I unconditionally forgive you for any and all wrongs that have occurred real or imagined. I ask that, if I have wronged you in any way, real or imagined, that you forgive me.

I hope to stay in the area at least through April so that I may serve my tax clients. I would like to rent mom's house starting Monday through the end of April with a contract for reasonable rent. You know that I will take care of the house and I would like to help in any way I can to get the house in order so that whatever is planned for the house will occur. Please let me know by Saturday since I will have to start looking for other housing arrangements if you choose not to rent to me on a reasonable basis.

Irrespective of the decision on the house, I would like to have us study the Bible together and the invitation to attend our church's Bible study still stands. However, I will not be teaching this week since I did not have a chance to prepare. Our minister is however and he is a worthy teacher, in my opinion. I would like us to become a family again and enjoy the last amount of time we have here together rather than remain estranged. Family is certainly more important than money and certainly more important than a contentious relationship. Hoping to here from you soon.

Latest update:

I have rented a room through Wednesday the 9th of January which means check out is Thursday at 11AM. I have also rented a car starting at 8AM Monday morning and required to be returned by 8AM Thursday morning.

 I plan to begin the hunger strike around 7AM on Monday and the protest around 9AM Monday. I'm going to take an hour break at noon and then be back until 4 or so. Hopefully, I have learned from the day I was involved with the 40 Days of Prayer for Life at the Peoria abortion clinic. According to the advanced weather forecasts for next week, the weather will be warmer than this week.

A quick update. I sleep over at mom's house last night. I woke up at 2:30AM with an idea from GOD, I hope. It's going to take time to develop so I'm postponing my protest and hunger strike at least for today. I've extended my motel room for a day and the car rental. I'll post again later today if there are further developments. I wanted everyone to know about the postponement. 

As an aside, the Republicans in the House have done what is now normal for them--they caved--even though they have a majority. Do they not understand that they have power? They kicked much down the road again and again and again!

Starting the 3rd, they will still have the majority but less of one. Will they EVER get a backbone and act like an opposition party? I'm looking for a new political party! How about you?

Update on my earlier post today. I have decided to rent the car I'm using for one more day because of the one day delay. Therefore, I will not start the outside protest until about 9:30AM. I will begin the actual hunger strike though at 7AM. I did an outside demonstration at a Peoria abortion (MURDER) clinic in early November. It was cold and windy but not nearly as cold as it is suppose to be tomorrow. At that time, I did 2 hours on and 2 hours off for six hours. Tomorrow, I plan to begin at 9:30AM and continue till noon. Then, I'll take an hour off and go from 1PM till 4PM. That's the plan. At the MURDER event, I was not on a hunger strike so the plan may change. I will keep updating as long as I am able.

Today's post:

When I moved back to Morton in 2004 from Tucson, I did so to take care of my mom. As I have said, mom had originally wanted me to pay rent. After some discuss she removed that and promised me than I could stay at her home as long as I wanted. Based upon that promise, I gladly provided services for mom without compensation--voluntary service. As a Christian, I believe it is and was my Christian responsibility to care for my mom.

I Timothy 5: 4 (NIV) "But if a widow has children or grandchildren, these should learn first of all to put their religion into practice by caring for their own family and so repaying their parents and grandparents, for this is pleasing to God."

With my eviction the new trustee through his actions retroactively revoked mom's promise. However, more than that occurred. The revocation of the promise also, by its very being, changed the nature of my service to my mother. It was no longer voluntary. For as I have stated and stated in court, I would not have stayed and cared for mom for over 7 years without that guarantee. Therefore my voluntary service became, in practice, involuntary servitude after the fact. And involuntary servitude is unconstitutional under
Amendment XIII.

Amendment XIII, Section 1, Paragraph 1

"Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."

This eviction is wrong on so many levels including on a constitutional basis. For seven plus years, I unknowingly was being used and abused by my brothers and sisters. I did not learn about this until my eviction judgement! Where is the justice?

Fortunately, GOD knows the truth and HE will provide justice to the oppressed. They won in court. I have already been victorious in the only court that really matters--GOD'S court!

The eviction will not occur until 8AM January 2, 2013. Therefore, the hunger strike will begin on January 2, 2013 at 8AM.

I hope and pray everyone has a great 2013. It doesn't seem to beginning well since Republicans in the Senate caved once again. Hopefully, for the long term good of the nation, the House Republicans WILL NOT!
