ANDOVER, Mass.—A Massachusetts high school is standing by its decision to punish a student for drinking at a party, even though evidence has emerged that she was sober and only there to pick up a drunken friend.
Erin Cox, 17, was at a yogurt shop with pals last week when a friend texted her saying she was at a party and too drunk to drive, the Boston Herald reported. The friend asked Cox to come get her.
‘I felt like going to get her was the right thing to do,’ Cox told the Herald. ‘Saving her from getting in the car when she was intoxicated and hurt herself or getting in the car with someone else who was drinking. I’d give her a ride home.’
Cox drove to a home and pushed her way through the party crowd just as police showed up. They arrested a dozen underage drinkers and warned 15 youths that they'd be summoned to court to face charges.
Cox was one of those told she’d be summoned for drinking at the party—even though she says she wasn’t. Local police officer Brian Neeley confirmed that the teen was sober, even submitting a written statement on her behalf.
But Cox’s school, North Andover High, has a zero-tolerance policy regarding underage drinking. Cox was removed as captain of the school volleyball team and suspended for five games. The student’s family filed a lawsuit trying to reverse the decision, but the court rejected it, saying it doesn’t have jurisdiction to change the school’s policy.
‘The school is really trying to take a very serious and principled stand regarding alcohol,’ said Geoffrey Bak, a lawyer for the school district.
The Cox family has filed a lawsuit that the school district immediately argued against. A judge ruled that a court did not have any jurisdiction in this case. When contacted for comment, neither the school district nor its attorney provided one to Boston station WBZ-TV.
‘She’s very fragile and I’m worried about her. Very worried about her. She didn’t do anything wrong,’ her mother, Elanor Cox said.”

When I was a member of the Marana, Arizona School Board, we passed a completely redesigned discipline code. We also had a no tolerance policy for drinking alcohol on school grounds. However, we had a built in safety valve. Before a penalty was enforced, it could be directly appealed to the Board. In my four years, we only heard one appeal.
Our high school, built years earlier, was in the middle of the district out in the country surrounded by cotton fields. A female honor student, who needed a ride to a home football game, was in the car when the occupants were disciplined for drinking in the parked car on school property. She appealed to the Board.
At the hearing, everyone agreed she had not been drinking. She was in the car because she was given a ride to the school. We removed the imposed suspension.
Our principal complained that we were undermining his decision and the discipline needed in the district. I disagreed. We put the appeal policy in for this very reason. The principal followed the policy. We reversed the decision based on fairness and common sense. True fairness not the Barack Hussein Obama faux fairness nonsense. We took the responsibility. The buck stopped with us.
Common sense says you do not punish someone for doing good or for not doing anything wrong.
